Terms and Conditions for the use of the Get Jobzi Website and Get Jobzi Job Application Service

  1. About the Terms and Conditions 

    1. These Terms explain how you can use our Website and the Jobzi Job Application Service (JAS), and they explain how we operate the Website and JAS. Please note that the JAS is an automated virtual assistant service to find and apply for jobs in the Service Territory only (currently only in the UK). The JAS is provided either as a Free Trial Package or a Standard Package. Please read these Terms carefully before you order either the Free Trial Package or the Standard Package. 

    2. The JAS currently searches and applies for jobs in the Service Territory (currently only the UK). If you do not have the right to work in the Service Territory (UK), do not use the JAS.

    3. During your use of our Website, during any telephone call or written correspondence between you and us and during the provision of the JAS these terms and conditions and Privacy Notice will apply. If there is any conflict between these Terms and any terms or conditions found elsewhere on our website, or in any written or verbal communication between you and us, these Terms will prevail.

    4. By ordering either the Free Trial Package or Standard Package, you are giving us and any relevant partner that we work with, your informed consent to provide the JAS you have ordered. This includes but is not limited to, sending your CV, name and email address to recruitment agencies, employers, or other entities that may have posted jobs on public jobs boards. 

    5. We may, at any time, without notifying you make any changes to the JAS which are necessary to comply with any applicable legal or other statutory requirements, or which are deemed necessary by us to uphold standards of service. In any event, we maintain that you will not be disadvantaged.

  2. Who We Are

    1. "We" are Xagrose Ltd, trading as Get Jobzi, a company registered in England and Wales (No. 08872252) whose registered office is at 7 the Broadway Preston Road Wembley Middlesex HA9 8JT.

    2. You" are the Website and/or JAS user and have accessed our Website, and may have placed an order for either version of the JAS.

  3. Words and Phrases Used In These Terms and Conditions

    1. Business Days: means Monday to Friday (except where such days fall on a bank or public holiday; in England) when banks in London are open for business.

    2. C.V. or CV: is an abbreviation for curriculum vitae, which is a short written description of your education, qualifications, previous jobs, and sometimes also your interests, that you send to an employer when you are trying to get a job.

    3. Data Protection Laws: means: the UK GDPR applies, the law of the United Kingdom or of a part of the United Kingdom which relates to the protection of personal data.

    4. Free Trial Jobzi Job Application Package (Free Trial): means the free trial version of the JAS available from the Website.

    5. Industry Sector Preference: is the industry sector or professional specialism (e.g. healthcare or financial services) you have provided to us to search for as part of the JAS we provide to you. 

    6. Jobzi Account: This is the user account we create for you for you to manage the JAS you have ordered.

    7. Jobzi Job Application Service or Job Application Service (JAS): is the job application service as described in clauses 14, 15 and 16, whether the Free Trial Package or the Standard Package.

    8. Jobzi Message Board or Message Board: is the private message board accessed via your login and provided to you as part of the JAS.

    9. Job Location Preference: is the location where you would like to work, including remotely where appropriate, that you wish us to use as part of the job search for the JAS service we provide to you.

    10. Job Title Preference: is the job title or job titles preference, as relevant, you have provided to us that you wish us to search for as part of the JAS we provide to you.

    11. Personal Data shall have the same meaning as in the Data Protection Act 2018, and their cognate terms shall be construed accordingly. 

    12. Processors or Processors shall have the same meaning as in the Data Protection Act 2018, and their cognate terms shall be construed accordingly.

    13. Service Fee: is the £25 (inc. VAT) fee paid by you for the Standard Package.

    14. Service Territory: means the United Kingdom of Great Britain and Northern Ireland (UK).

    15. Standard Jobzi Job Application Service (Standard Package): means the paid version of the JAS available from the Website.

    16. Website: means the website at https://getjobzi.com.

  4. accounts and registration

    1. In order to access either the Free Trial Package or Standard Package you must register for a Jobzi Account. When you register for an account, you will be required to provide us with some information about yourself, this includes your name and email address. 

    2. When you register, you will be asked to provide a password. You are responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account. If you believe that your account is no longer secure, then you must immediately notify us at support@getjobzi.com.

    3. We advise you that you use a personal email address when you create your Jobzi Account. However, if the domain of the email address associated with your account is owned by a third-party organization and was assigned to you as an employee, contractor or member of the organization (such as yourname@youremployer.com), you acknowledge and agree that we may be legally obliged to identify your account to the organization, migrate your account to the organization’s account, and/or restrict or terminate access to your account. We will have no liability to you in connection with any such disclosure, restriction, or termination.

  5. your use of the service and website

    1. You may only use the Website and JAS for the lawful purposes of seeking lawful employment in the Service Territory. You may use the Website and JAS while you are located outside of the Service Territory, but the service will always be limited to job searches and applications for jobs within the Service Territory.

    2. If you do not have the right to work in the Service Territory, do not use the JAS.

    3. You must not under any circumstances seek to undermine the security of the Website or JAS. In particular, but without limitation, you must not seek to access, alter or delete any information to which you do not have authorised access, seek to overload the system via spamming or flooding, take any action or use any device, routine or software to crash, delay, damage or otherwise interfere with the operation of the Website or JAS or attempt to decipher, disassemble or modify any of the software, coding or information comprised in the Website or JAS.

  6. Your personal data

    1. We collect, use, and protect your Personal Data as described under these Terms and in our Privacy Notice. Your consent to our Terms and Privacy Notice is required before you are able to use JAS.

    2. You may only use this service using your real name and email address you use for job applications. You are not permitted to use this service on someone else's behalf.

    3. Make sure you input the all data correctly, if you do not understand something, please check the FAQs. 

    4. Your C.V. is required to use either the Free Trial Package or Standard Package. If you do not want to submit your C.V., please do not use either service.

    5. You are solely responsible for any information, including your uploaded C.V., submitted by you to the JAS and/or the Website. You are responsible for ensuring that all information supplied by you is true, accurate, up-to-date and not misleading or likely to mislead or deceive and that it is not discriminatory, obscene, offensive, defamatory or otherwise illegal, unlawful or in breach of any applicable legislation, regulations, guidelines or codes of practice or the copyright, trademark or other intellectual property rights of any person in any jurisdiction. 

    6. You are also responsible for ensuring that all information, data and files are free of viruses, malware or other routines or engines that may damage or interfere with any system or data prior to being submitted to the Website or JAS. 

    7. We reserve the right to remove or delete any information supplied by you to us, where we believe it to be untrue, inaccurate, out-of-date, misleading or likely to mislead or deceive, discriminatory, obscene, offensive, defamatory or otherwise illegal, on our sole discretion, at any time and for any reason without being required to give any explanation. Where we delete such information, we also reserve the right to delete your Jobzi Account, and bar you from accessing the service. In such circumstances, we will not be obliged to refund any payments you may have made.

    8. Within 30 days of the end of the JAS service Free Trail or Standard Package we will delete all your Personal Data, including your uploaded C.V.s.

  7. PURPOSE OF PROCESSING your PERSONAL DATA 

    1. We shall process your Personal Data strictly for the purpose of providing the JAS service on the basis of the informed consent to these Terms and our Privacy Notice you provided when you ordered the service.

  8. PROCESSING OF your DATA

    1. Subject to its obligations under the Data Protection Laws, we shall:

  1. only process Personal Data as required under these Terms, unless additionally required to do so by Data Protection Laws, in which case we shall to the extent permitted by the Data Protection Laws inform you, of that legal requirement before the relevant processing of that Personal Data; and

  2. comply with the Data Protection Laws in the processing of your Personal Data; and

  3. implement appropriate technical and organisational measures, insofar as this is possible, in order that natural persons cannot be directly or indirectly identified as part of the data processing; and

  4. delete all Personal Data 30-days after the deletion of your account or end of JAS. 

  1. our PERSONNEL

    1. We shall take reasonable steps to ensure the reliability of any employee, agent or contractor who may have access to your Personal Data, ensuring in each case that access is strictly limited to those individuals who need to know/access the relevant Personal Data, as strictly necessary for the purposes of this under these terms, and to comply with Data Protection Laws in the context of that individual's duties to us, ensuring that all such individuals are subject to confidentiality undertakings or professional or statutory obligations of confidentiality.

  2. SECURITY

    1. Taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons, we shall in relation to your Personal Data implement appropriate technical and organisational measures to ensure a level of security appropriate to that risk.

    2. In assessing the appropriate level of security, we shall take into account the particular risks that are presented by processing, in particular from a Personal Data breach.

  3. DATA PROCESSORS

    1. We may appoint Processors (and permit each such Sub-Processor to appoint) Processors in accordance with this Clause and any restrictions of these Terms.

    2. We, shall before the appointment of a Processor:

      1. carry out adequate due diligence to ensure that the Processor is capable of providing the level of protection for Personal Data required by under these Terms; and

      2. ensure that the arrangement between us and the Processor, is governed by a written contract including terms which offer at least the same level of protection for Testee Personal Data as those set out under these terms and meet the requirements of the Data Protection Laws.

  4. your DATA RIGHTS

    1. Taking into account the nature of the JAS and the way the JAS works, you are automatically provided with all your Personal Data held by us via their account login. 

    2. In any case, we shall directly respond to each request as required by the Data Protection Laws.

  5. Privacy notice

    1. Please also review our Privacy Notice: http://www.getjobzi.com/privacy_notice.  Please be advised the Website and JAL are hosted in the United Kingdom. If you access either from any other country the laws or other requirements governing personal data collection, use, or disclosure are likely to differ from applicable laws in the United Kingdom, then through your continued use of the Services, you are transferring your data to the United Kingdom, and you expressly consent to have your data transferred to and processed in the United Kingdom.

  6. about the Jobzi job application service

    1. The Jobzi Job Application Service (JAS) is a service provided by us to you for the sole purpose of finding and applying for jobs in the Service Territory job boards on your behalf as an automated virtual assistant. For the avoidance of doubt, we are not a recruitment agency.

    2. We offer as standard a Free Trial (see below) in order to test the service against your requirements and preferences. If you are not satisfied with the service in the Free Trial Service do not purchase the Standard Package.

    3. The JAS consists of the following elements:

      1. User input and storage of your contact details, i.e. input of your name and Verifiable Email Address; 

      2. User input and storage of your account password;

      3. Accepting credit card payment from you via our third-party credit card merchant account or Paypal;

      4. User input and storage of your Job Title Preference, Job Location Preference, and Industry Sector Preference;

      5. Upload and storage of your C.V.;

      6. Creation of accounts on job boards on your behalf;

      7. Searching and identification, where possible, of your Job Title Preference and Job Location Preference;

      8. Automated submission of job applications on your behalf to jobs advertised on job boards;

      9. Automated email notifications of job applications made on your behalf;

      10. Jobzi Message Board where the emails from recruiters in relation to the applications made by JAS are accessible by you; and 

      11. Deletion of all your Personal Data within 30 days, upon the end of the JAS or deletion of your account.

    4. The JAS searches for jobs and makes applications on your behalf on Business Days. This is because the large majority of jobs are posted on these days. We do not make any guarantee to make applications for any particular job posting, or to make applications at any particular time of day.

    5. We will apply for a maximum of 20 jobs per Business Day on your behalf, on jobs boards in the Service Territory.

    6. Provided that jobs are available on the reputable job boards we search, according to your Job Title, Job Location and Industry Sector Preferences, we shall make applications on your behalf. However, we are not able to check the accuracy or validity of such job postings. We do not accept any liability arising from any inaccuracy or omission in any of the information on the job board postings or any liability in respect of your subsequent dealings with any recruitment agency or employer. 

    7. We do not make any promise of applying for a certain number of jobs or finding you a job.

    8. You will not receive any notifications or forwarded messages from us if we have not been able to find any jobs in your job search. 

    9. It is entirely your responsibility to respond to recruiters, in a timely manner, with respect to any messages we have forwarded to you in your JAS message board. We recommend that you immediately email recruiters directly from your usual email service if you are selected for the next stage of the recruitment process. You cannot use the JAL message board to email recuiters.

    10. You may pause the Standard Package of JAS at any time for up to 30 days. If you do not reactivate your paused account within 30 days, we will email you with the option to reactivate or delete your account.   

    11. You may or delete your Jobzi Account at any time via your login.

  7. Free Trial Standard

    1. In order to test the suitability of the JAS for new users, we offer a free trial for a maximum of 20 job applications or 120 hours (5-days), whichever ends is soonest.

    2. Once the Free Trial has expired, you will be given the option to upgrade to the Standard Package within 30 days. If you do not upgrade to the Standard Service within 30 days your account will be deleted.

    3. The Free Trial allows you to choose one Job Title Preference and one Industry Sector Preference to be used as part of the automated job search.

    4. You cannot pause the Free Trial Package of the JAS.

    5. You can delete your Free Trial account at any time while your account is active.

  8. Standard package

    1. The Standard Package allows you to choose up to three Job Title Preferences and three Industry Sector Preferences to be used as part of the automated job search.

    2. The Standard Package will apply for a maximum of up to 20 jobs per Business Day for a total maximum of up to 250 job applications, or for a maximum duration of 30 days if JAS has not been able to find a sufficient number of jobs according to your preference. When the 250 applications limit has been reached or the 30-day period has ended, you will be given the option to extend the Standard Package within 30 days. If you do not extend the Standard Package within 30 days your account will be automatically deleted.

    3. You can pause the service or delete your account at any time while your account is active.

  9. monitoring your Jobzi message board

    1. The Jobzi Message Board is where the emails sent by recruiters will go. These are mainly job application confirmation emails that do not require a response or any action from you. However, it is possible that there may be messages that require some kind of action from you. Where you are required to respond to recruiters, you should either email them directly from your email service or call them directly.

    2. It is your responsibility to monitor the messages in your Jobzi Message Board.

  10. payment

    1. The Standard Package requires you to pay the Service Fee which will be taken by a credit card payment. Before you pay any fees, you will have the opportunity to review and accept the fees that you will be charged. All fees are in GBP and are non-refundable.

    2. We use Stripe Payments UK, Ltd to process Visa and Mastercard credit card payments and PayPal UK Ltd to process Paypal payments. 

    3. You will be required to provide valid credit card details and your credit card billing address to authorise your payment.

  11. Interruptions and Omissions in Service

    1. We shall endeavour to ensure that the standard of the JAS and Website remains high and to maintain its continuity, the Internet is not always reliable, and errors, omissions, interruptions of the JAS service and delays may occur at any time. We do not accept any liability arising from any such errors, omissions, interruptions or delays or any ongoing obligation or responsibility to operate the Website or the provision of the JAS. 

    2. We may vary the design and specification of the Website from time to time without notice.

  12. Intellectual Property

    1. All content, materials, and intellectual property on the Service are owned by us and our licensors. You agree not to reproduce, modify, or distribute any content from the Service without prior written consent.

    2. The Website and JAS is owned and operated by us. The visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, and all other elements of the JAS provided by us are protected by intellectual property and other laws. 

  13. Termination

    1. We reserve the right to terminate or suspend your account and access to the Service for violations of these Terms or for any other reason, with or without notice.

  14. Disclaimers

    1. The Service is provided "as is," and we make no warranties regarding its accuracy, reliability, or suitability for your needs. We do not guarantee job placements, and the use of our service is not a guarantee of employment. This is why we have a Free Trial Service, so you may test it for suitability for your needs.

  15. Liability

    1. We reject any and all liability in connection with any uploaded C.V. files you upload to the JAS service. You are solely responsible for the content of the C.V. files and the consequences of providing such files via the JAS. By uploading such files, you affirm, represent, and warrant that:

      1. you are the creator and owner of the C.V. files, and have the necessary licenses, rights, consents, and permissions to authorise us to distribute your C.V. files as necessary to provide the JAS in a manner compatible with these Terms;

      2. your C.V. files, and the use of your C.V. as contemplated by these Terms, does not and will not: 

        1. infringe, violate, or misappropriate any third party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right;

        2. slander, defame, libel, or invade the right of privacy, publicity or other property rights of any other person; or 

        3. cause us to violate any law or regulation; and

        4. be deemed by a reasonable person to be objectionable, profane, indecent, pornographic, harassing, threatening, embarrassing, hateful, or otherwise inappropriate.

    2. To the extent permitted by law, our total liability to you in respect of any losses arising under or in connection with these Terms, whether in contract, tort, or otherwise, shall in no circumstances exceed the price paid for the JAS.

    3. If at any time we are prevented or hindered from carrying out our obligations under these Terms for reasons beyond our control, including strikes, lock-outs or other industrial disputes (whether involving our workforce or the workforce of any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors, we shall notify you accordingly and, our obligations under these Terms shall be suspended until the obligations can be performed.

    4. Nothing in these Terms limits or excludes our liability for breach of our legal obligations; death or personal injury resulting from negligence; or fraud or fraudulent misrepresentation. Your statutory rights as a consumer are unaffected.

    5. You agree to indemnify us and keep us indemnified against all costs, expenses, claims, losses, liabilities or proceedings arising from use or misuse by you of the Standard Package, Free Trail Package and/or Website.

  16. General

    1. We may amend these Terms at any time to ensure compliance with relevant laws and regulations. By continuing to use the Website and/or JAS after any changes are made, you accept those changes and will be bound by them.

    2. You shall not be entitled to assign or otherwise deal with your rights or obligations under these Terms.

    3. If any part of these Terms shall be found by any court of competent jurisdiction to be invalid or unenforceable but would be valid and enforceable if certain words were deleted or added, such provisions shall apply with such amendments as required to make them valid and enforceable. In any event, any invalidity or unenforceability shall not affect the other provisions of these Terms, which shall remain in full.

    4. These Terms shall be governed by and construed in accordance with the laws of England and Wales and each party hereby irrevocably submits to the exclusive jurisdiction of the English Courts. However, if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
